1. Agreement

These Terms and Conditions ("Terms") govern the use of services provided by Dayson Kitchen & Bath, LLC ("DKB," "we," "us," or "our"), a New Jersey limited liability company. By engaging our services or using our website, you agree to these Terms.

2. Services

DKB provides kitchen and bathroom renovation, design services, custom cabinetry, and other home improvement services in Bergen County, New Jersey and select areas of Rockland County, New York. All work is subject to local building codes and permit requirements.

3. Estimates and Proposals

  • Written estimates are valid for 30 days from the date issued

  • Estimates are based on visible conditions and specifications discussed

  • Changes to project scope may result in additional costs

  • Final proposals require written acceptance and deposit to proceed

4. Payment Terms

  • Deposit: [X]% due upon contract signing

  • Progress payments according to project milestones

  • Final payment due upon substantial completion

  • Accepted payment methods: check, cash, credit card, financing (if available)

  • Late payments may incur fees and work stoppage

5. Scheduling and Delays

  • Start dates are approximate and subject to permit approval

  • Completion times are estimates based on normal conditions

  • Delays due to weather, material availability, or circumstances beyond our control may extend timelines

  • Customer-caused delays (selection changes, access issues) may result in additional charges

6. Change Orders

All changes to original specifications must be documented in writing and may affect project cost and timeline. Verbal change requests are not binding until written confirmation is provided.

7. Materials and Warranties

  • DKB warrants installation workmanship for [X years]

  • Manufacturer warranties apply to all products and materials

  • Warranty claims must be submitted in writing

  • Warranties do not cover normal wear, misuse, or Acts of God

  • Customer is responsible for maintenance per manufacturer guidelines

8. Customer Responsibilities

  • Provide clear access to work areas

  • Remove personal items from work spaces

  • Ensure pets and children are supervised

  • Make timely decisions on materials and design choices

  • Obtain HOA approvals if required

9. Limitation of Liability

DKB's liability is limited to the contract value. We are not responsible for:

  • Indirect or consequential damages

  • Pre-existing conditions discovered during work

  • Damage from hidden defects in structure

  • Issues arising from customer-supplied materials

10. Insurance and Licensing

DKB maintains general liability insurance and all required New Jersey and New York licenses. Certificates of insurance are available upon request.

11. Cancellation Policy

  • Cancellations must be submitted in writing

  • Deposits are non-refundable after materials are ordered

  • Cancellation after work begins will incur charges for work completed and materials purchased

12. Dispute Resolution

Disputes will first be addressed through good faith negotiation. If unresolved, disputes will be subject to mediation in Bergen County, New Jersey, before pursuing other legal remedies.

13. Website Use

  • Website content is for informational purposes

  • Photos represent our work but individual results may vary

  • We reserve the right to use project photos for marketing unless otherwise agreed

14. Privacy

Customer information is kept confidential and not sold to third parties. We may use project photos and testimonials for marketing purposes unless you opt out in writing.

15. Compliance

All work complies with applicable building codes. Customers are responsible for HOA rules and historic district requirements in their area.

16. Entire Agreement

Written contracts supersede all verbal agreements. These Terms, along with signed proposals and change orders, constitute the entire agreement.

17. Severability

If any provision is deemed unenforceable, remaining provisions continue in full effect.

18. Governing Law

These Terms are governed by New Jersey law.

19. Updates to Terms

We may update these Terms periodically. Current version will be posted on our website.
